Helping injured women patients of Ascension cancer doctor

Dr. Malviya treated patients at Ascension hospitals in Michigan from 2011 to 2017. Women patients allege that Dr. Malviya performed medically unnecessary surgery procedures on them, including radical hysterectomies and excessive chemotherapy. As a result, the women claim they suffered serious and irreparable harms and losses from the misconduct. In April 2022, the U.S. Department of Justice punished Dr. Malviya for unnecessary surgeries and chemotherapy on women in those years, after medical coworkers alerted law enforcement in 2017.

In July 2017, three whistleblowers alerted the U.S. government under the False Claims Act that a gynecologic oncologist was performing medically unnecessary procedures on women patients, and that Ascension hospitals in Michigan were profiting from those procedures. Last year, Ascension Michigan admitted the charges and was ordered to pay $2.8 million to reimburse the government for services provided by the doctor that were characterized as overtreatment, both surgical and non-surgical. The doctor’s identity was not revealed to the public.
However, on April 14, 2022, the Department of Justice revealed the identity of the gynecologic oncologist who had performed these medically unnecessary procedures on women as Vinay Malviya MD. The Department announced that Malviya agreed to pay $775,000 to resolve False Claims Act allegations against him. Malviya also agreed to be excluded from Medicare, Medicaid, and all other federal health care programs for a term of three years.
Allegations against Malviya were that he performed radical hysterectomies when only simple hysterectomies were medically necessary, that he administered and ordered excessive chemotherapy over what was medically necessary, and that he was paid for evaluations and management services not performed or not rendered as represented.
